About the Principal

Mr. Hoffenberg is well suited to help small and medium size business grow and prosper through the utilization of intellectual property (IP) rights and to provide guidance regarding exposure for infringement and in-licensing must have rights held by others.

 

Mr. Hoffenberg holds a Juris Doctor degree (1985) from DePaul University in Chicago, Illinois. He was on Law Review and received an American Jurisprudence Award in torts. He is admitted to practice law in California, Illinois and New York and a registered patent attorney before the United States Patent and Trademark Office. He is a member of the bar for the United States Supreme Court, the United States Court of Appeals for the Seventh, Ninth and Federal circuits and United States District courts in California and Illinois.

 

For a technical background, Mr. Hoffenberg has a Bachelor of Science degree (1982) in chemistry and biochemistry from the University of Illinois. He refined a lithographic process as an engineer for the Rauland Picture Tube Division of Zenith Radio Corporation (Melrose Park, Illinois.) Mr. Hoffenberg developed adhesives and fiberglass products for the W.H. Brady Company (Milwaukee, Wisconsin.) He did protein research at the University of Illinois Medical School.

 

After finishing law school, Mr. Hoffenberg took an associate position with WILSON, KENNA & BORYS, Los Angeles, California. At Wilson's firm, Mr. Hoffenberg provided representation in litigation matters concerning employment, construction and insurance coverage.

Mr. Hoffenberg moved to an associate position at SHELDON & MAK, Inc., Pasadena, California. At Sheldon's firm, Mr. Hoffenberg provided full service representation on intellectual property matters; namely, patent and trademark application prosecution, licenses and contracts, client counseling, opinion letters and litigation. He also assisted clients with certain employee related matters.

Mr. Hoffenberg then moved to an associate position at CHAPIN, FLEMING & WINET, Los Angeles, California. There he provided representation in insurance coverage litigation.

In 1999, Mr. Hoffenberg founded the LAW OFFICES OF HOWARD HOFFENBERG and has practiced as a solo practitioner in the areas of intellectual property and business law.

Mr. Hoffenberg's experience in patent and intellectual property litigation provides him with a keen approach to client counseling, licensing and prosecuting patent applications. He has first hand familiarity with problems and weakness in patents and licenses that come out in litigation. He utilizes this knowledge to draft stronger patent protection policies, licenses and patent applications that are less prone to attack in litigation. This provides him with an advantage over an attorney which does strictly prosecution and transactional work.

 

Key patents for which Mr. Hoffenberg drafted the original application that was filed with the US Patent Office are: US 5,922,608 for Macromolecule Sequencing Packet and Method of Use; U.S. 6,110,749 System for Simultaneously Conducting Multiple Ligand and Binding Assays and 6,686,084 for Gas Blocking Mechanism for Water Removal in Fuel Cells.  Key patent litigation on which Mr. Hoffenberg was counsel that resulted in published opinions are: Suresafe Industries, Inc. v. C.& R Pier Mfg., 850 F.SUPP. 869 and Andamiro USA v. Konami Amusement of America, Inc, 59 U.S.P.Q2d The 1094, 2001 WL 535667.
